Chain Stores in the Food Retail Sector Are Obliged to Share Data. 06 December 2022

The Regulation on Amending the Regulation on the Principles and Rules to be Applied in Retail Trade (hereinafter referred to as "Regulation") has been published and entered into force.

With this Regulation; Article 12/Ç was added to the Regulation on the Principles and Rules to be Applied in Retail Trade published in the Official Gazette dated 6/8/2016 and numbered 29793. Pursuant to the Regulation,

  • Chain stores, which are engaged in the sale of fast moving consumer goods in the food retail sector and with more than two hundred branches, are obliged to transfer the data regarding the products they sell and their branches to the system determined by the Ministry of Commerce. The procedures and principles of this transfer will be determined by the Ministry of Commerce.
     
  • With the added Article 12/Ç; by making it possible to share these transferred data with the relevant institutions, organizations and the public; It is aimed to inform the public and enable the consumer to make price comparisons
     
  • However, the information to be shared with the public subject to data transfer is left unclear. We believe that, this uncertainty has been left consciously. Therefore all kinds of information to be requested from chain stores whose criteria are specified in the Regulation can be evaluated within this scope.
     
  • At this point, it may be possible to transfer the commercial information of the chain stores to the specified system.
     

In conclusion, regarding the data sharing regulated by the Regulation; we believe that questions such as what information will be shared with the consumer and to what extent, under what conditions this data, which can be considered as Confidential Information, will be stored in the system by the Ministry of Commerce and for what periods, whether it will be transferred to third parties or not will be discussed in the coming days.
